EDUCATION AGREEMENT

This Education Agreement is entered into as of PURCHASE DATE and between Sandra Lee Peckinpah (referred to in this Agreement as “Instructor” and Purchaser (referred to in this Agreement as “Student”).

Whereas, Instructor teaches individualized educational course with a curriculum specifically designed to assist and provide professional guidance to individual students who desire to write articles, blogs, editorials and books for publication.

Whereas, Student is an individual who desires to learn the skills necessary to write articles, blogs, editorials and books and to potentially have those authored works published.

Whereas, Student and Instructor desire to enter into this Agreement for the Instructor to teach and assist the Student with the necessary skills to create and draft various literary works which may be suitable for publication.

The Instructor’s programs take a lot of work and discipline, just like any worthwhile endeavor or continuing education program. Our coaching and programs are intended to help you share your message with a wider audience and to make a difference in the world by writing your book(s), articles, or blogs.

Enrolling in our program does not guarantee that the Student will have a published book, article, or blog. Our intention is that we want to motivate and guide serious people, dedicated to completing the program. We cannot and do not make any express or implied warranties or guarantees that completion of our courses will result in the publication of any of the Student’s literary works or the Student’s ability or likelihood to earn any money with our ideas, information, tools, or strategies.

We want our Students to succeed!  Each Student’s success depends on their ability to continue! We want to help guide you by providing content, direction, feedback and strategies to succeed in the publishing industry. However, all our products and services are for educational and informational purposes only. Nothing on this page, any of our websites, or any of our content or curriculum is a promise or guarantee of results or future earnings, and we do not offer legal, medical, tax or other professional advice.

All our Students are encouraged to research costs of publishing, programs, and other things related to meeting your publishing goals. Making decisions based on any information presented in our products, events, services, or website, should be done only with the knowledge that you could experience risk or losses just like any educational or entrepreneurial endeavor.

With any new business enterprise, we recommend that all of our Students use caution and always consult with their accountant, lawyer or other legal advisor before acting on this or any information related to publishing, business, or finances.

Although we cannot guarantee the success of your writing career, if you are not happy with the quality or content of our educational courses, you can cancel and receive a 100% refund per these guidelines:

  • Can show proof that you listened, participated in the videos, coaching calls, and fulfilled your part by doing the writing and completing homework/worksheets.
  • “The Emerging Writer Academy” cancelation needs to be within the first 15 days of the contract for a refund.
  • “Blogging is The New Calling Card,” cancelation must occur before Session 3 of the course presentation for a refund.
  • Cancelation must be in writing, along with proof of work, and sent to [email protected] and confirm receipt. 

Limitation of Liability.  YOU ARE RESPONSIBLE FOR THE CONTENT OF YOUR OWN WORK. IN NO EVENT SHALL THE INSTRUCTOR OR ANY OF HER AGENTS OR EMPLOYEES BE LIABLE TO THE STUDENT FOR ANY INDIRECT, SPECIAL, CONSEQUENTIAL, PUNITIVE, INCIDENTAL OR SIMILAR DAMAGES, INCLUDING DAMAGES FOR HARM TO BUSINESS, LOSS OF BUSINESS, LOST PROFITS OR LOST SAVINGS.

Indemnification by Student.  Student shall indemnify, defend and hold harmless Instructor, her Affiliates and their respective directors, officers, employees, representatives and agents, from and against any and all Losses arising out of or resulting from Claims based upon: (i) any claimed infringement by a Third-Party including but not limited to copywrite or patent infringement; (ii) any representation, warranty, covenant or agreement made by the Instructor which is contained in this Agreement.

 

This Agreement may not be amended or modified except by a written instrument specifically referring to this Agreement and signed by an authorized representative of both the Instructor and Student.

 

This Agreement contains the entire understanding of both the Instructor and Student with respect to the subject matter of the Agreement and supersedes all prior or contemporaneous agreements or understanding.

 

Both Instructor and Student hereby consent to the exclusive jurisdiction of the state and federal courts sitting in Riverside, California in any action on a claim arising out of, under or in connection with this Agreement or the transactions contemplated by this Agreement, provided such claim is not required to be arbitrated under this Agreement.

Except as otherwise provided in this Agreement, any controversy or claim arising out of this Agreement or relating to it will be settled by arbitration in Riverside County, California before a single arbitrator appointed in accordance with the rules of Judicial Arbitration and Mediation Service (JAMS). In all other respects, the arbitration will be conducted in accordance with Part III, Title 9 of the California Code of Civil Procedure. Judgment upon an award rendered in such an arbitration may be entered in any court which has jurisdiction. Whether or not this Agreement is being or will be arbitrated, either party may seek and obtain prejudgment remedies from an appropriate authority. The parties will have the right to discovery in accordance with Section 1283.05 of the California Code of Civil Procedure
